In the United States, recent actions by Immigration and Customs Enforcement (ICE) have drawn comparisons to authoritarian tactics abroad. According to court documents, ICE agents claimed that Alberto Castañeda Mondragón, a Mexican immigrant, suffered bone fractures and head injuries after he “purposefully ran headfirst into a brick wall.” This explanation was challenged by medical staff who treated him, leading a judge to order his immediate release.
Concerns about government overreach have also surfaced in other incidents. A Philadelphia man who emailed a Department of Homeland Security prosecutor in support of an Afghan man facing deportation received notice from Google that his account information had been subpoenaed by the Department of Homeland Security.
Critics argue that President Donald Trump’s support for ICE operations undermines constitutional protections. “Donald Trump is free to express his admiration for Putin, but it would be nice if he better understood that the United States operates under the rule of law, guided by the Constitution. Instead, the president is doubling down on ICE raids that obliterate the concepts enshrined in our founding document and engaging in the kind of disinformation more closely associated with Moscow.”
The administration has stated its focus is on targeting serious offenders. However, CBS News reported that less than 14 percent of nearly 400,000 immigrants arrested by ICE during Trump’s first year back in office had charges or convictions for violent criminal offenses.
A federal court recently highlighted concerns about compliance with judicial orders: “Attached to this order is an appendix that identifies 96 court orders that ICE has violated in 74 cases. The extent of ICE’s noncompliance is almost certainly substantially understated. … This list should give pause to anyone — no matter his or her political beliefs — who cares about the rule of law. ICE has likely violated more court orders in January 2026 than some federal agencies have violated in their entire existence.”
These developments raise questions about potential violations of several constitutional amendments and challenge traditional interpretations held by some conservatives and libertarians regarding government authority and limits.
“The entire purpose of the Constitution is to limit how government agencies behave while they exert their powers under the law,” one critic noted.
The debate continues over whether strong immigration enforcement justifies actions perceived as inconsistent with constitutional protections.
